Terms for a template website:
Throughout this contract, the “client” shall refer to the legal representative of your business and LMS will refer to Lexi Media Services.
The template website offer gives the client 90 days free use of the website. For continued use after the initial 90 days, the client will revert onto the standard template website service plan. The standard payment plan is ongoing for as long as the client wishes to utilise the website.
For continued use of the template website, an ongoing fee of £75/m is payable. This fee is subject to change due to inflation of services outside our control. Any increase of prices will be notified. Any custom features added to the website may increase the monthly service fee. The client will be notified of this when quoted for the customisation.
Should the service fee not be paid, the website will be shut down for use. Arrangements can be made to re-instate the website at a later date. An admin fee will be payable to do so and will vary dependant on varying factors. The client will be quoted for restoration fees.
Full admin access to the website can be granted once a complete initial payment fee (IPF) totalling £675 has been paid. This is equivalent to 9 months ongoing monthly service fee payments. The client can choose to pay this, or the outstanding balance at any earlier opportunity.
If the client wishes to sever the contract at any time, please give 1 months’ notice by emailing [email protected] using the subject “severance”.
If the client is utilising their own domain, they are responsible for its renewal fees to ensure it is kept owned. LMS cannot be held responsible if the website ceases to work due to a lapsed renewal owned by the client.
If the client purchases a domain from LMS, domain renewal fees will be covered within the ongoing service fee. The domain will remain active for as long as the client continues to pay the service fees.
If the client fails to keep up the service fees, the domain will not be renewed and may not be obtainable in the future.
Should the client wish to transfer the domain to another hosting company at a later date, there will be a £75 admin fee to do so.
A premium hosting account will be used to host the website. Hosting fees are covered within the service plan. There will be no ongoing additional fees for hosting for as long as the service fees are paid.
Should the website hit server limits due to demand, the client will be notified of recommended upgrades and the costs involved to do so.
A single email account will be set up for the client’s business utilising the client’s domain. The client can choose the local-part in the customer content collection form.
Further email accounts can be setup at additional costs. Please contact LMS to retrieve a quote for works.
LMS will aim to make the website live within an approximate timeframe of 4 weeks from order. This is subject to having all required data and content from the client. There is no guaranteed date to go live.
The website will be built on the WordPress CMS platform using plugins required for website use and functionality. All website plugins will be the non-premium versions unless specified in this contract. If any premium plugins or tools are required, the client is responsible to the payment of fees direct to the software company.
Premium plugins utilised for the website build will include:
- Elementor Professional
- All-In-One Migration
Renewal fees for these premium plugins will be covered within the service plan. If the client wishes to self-maintain the website and dis-continue the service plan (subject to IPF), these premium licences will lapse, and the client will be responsible for obtaining new licences at their own expense. This will not affect the current functionality of the website but will prevent any future security and functionality updates being applied.
The website will be built to function effectively and look good across multiple devices including desktop computers, laptops, tablets, and mobile devices.
Extra features will be implemented to ensure the website performs well, responds quickly, and helps ensures website up-time. These will be non-premium performance tools and plugins.
Additional security tools and plugins will be installed to help prevent website attacks by automated bots. This does not guarantee the website will not be hacked. These will be non-premium plugins.
Backups and Updates:
The ongoing service plan ensure that the website is included in the backup and update programme. The website will have all its data backed up daily in multiple locations to ensure that if needed, the website can be restored quickly and easily. WordPress, themes, and plugins will be updated regularly to ensure security, add improvement features and fix any reported issues. This will keep the website not only more secure but also running smoothly and optimised. The website will be checked regularly to ensure it functions correctly.
The design is of a fixed template design as previously shown to the client. The design will not change except for the items listed below.
The client is responsible for providing the company logo in a large resolution (min 2000 pixels on the shortest edge) and in a suitable format (EG a PNG file if it is required to have a transparent background) to LMS.
The main branding colours will be taken from existing client material (such as a logo) if no specific colours are specified. Where specific colours are chosen by LMS, a branding sheet will be supplied to the client to continue the colour use in other materials they may need.
The client is responsible for the main text of the website and must submit all text to LMS in order to build the website in line with the initial design needs. The client is also responsible for any images and video required. The client ensures they have sufficient rights to use any and all media and permission of any persons depicted in any media. LMS takes no responsibility for any copyright infringement for any media or content used.
LMS will provide an online content collection form to enable the client to send all relevant content to LMS for use in the website.
Search Engine Optimisation (SEO):
Basic on-site optimisation will be done during the build. However, there is no offer of an ongoing SEO strategy. If this is required by the client, it is the client’s responsibility to hire a suitable SEO partner.
Google Search Sponsored Ads:
This quote does not include any Google advertising for the client. However, LMS can assist with Google Advertising and the client should request a quote if it is required by emailing [email protected].
Social Media Marketing:
There is no offer of any social media marketing. If this is required by the client, it is the client’s responsibility to hire a suitable social media marketing partner.
A Facebook pixel code can be installed on the website. This can help collect data of visitors ready for if and when the client decides to run Facebook advertising campaigns. The client will need to provide the page-view pixel code to install. LMS can support setting up a Facebook Pixel if not already done so (subject to fees).
Facebook & Instagram Ads:
This quote does not include any Facebook advertising for the client. However, LMS can assist with Facebook Advertising and the client should request a quote if it is required by emailing [email protected].
Any other marketing:
There is no offer of any other form of marketing to drive traffic to the website. It is the responsibility of the client to adopt a suitable marketing strategy to drive traffic to their website or hire a suitable marketing agency to do so.
Email Marketing & Newsletters:
LMS will create a MailerLite account for the client in order to utilise email newsletters. The basic account is free for up to 500 subscribers. The client will be responsible for any further fees should they exceed the free subscription limit.
The client is responsible for any and all content which is sent from the MailerLite account. LMS will not be help responsible.
Should the MailerLite account be suspended or shut down for breach of terms by the client, LMS will assist to re-open the account or setup an alternative account subject to admin fees.
Should the client sever the contract with LMS, the email account will be closed unless the IPF is paid in which case the account ownership will be transferred.
If the IPF is not complete and client wishes for the contacts to be exported, this can be arranged subject to an admin fee. It is the responsibility of the client to ensure the data sent to them remains secure in line with GDPR rules and regulations.
Should there be any issues with the website after going live, LMS will offer support to the client to restore and continue functionality. If the fault is due to something missed or overlooked during the build, LMS will rectify for no charge. If the fault is due to something changing after the going live date and not an error by LMS, this rectification may be subject to a fee, dependant on how much work is required to rectify. Should the client wish to make amendments to the website, this can be done and will be subject to fees. Amendments and upgrades should be requested by emailing [email protected]
You will be provided access to a training support portal where you will find useful “how-to” video lessons on common aspects and how to utilise your website. Any further training requirements may be subject to further fees. A request and quote should be obtained by emailing [email protected].
